Thumbs down Australian Immigration Department > Disgusting!

This is disgusting, I understand this person has made a few mistakes! But how low can the immigration department really go! Phillip Ruddock is a cockhead!

Quote:

The family of a Melbourne man stripped of his residency and deported from Australia is pleading with the Federal Government to let him return home.

Robert Jovicic, 38, was born in France to Serbian parents and arrived in Australia as a two-year-old but his permanent residency was revoked two years ago after a string of drug-related burglary offences.

He was deported to Serbia last year but it has refused to recognise him as a citizen, leaving him stateless with no right to work or welfare.

Mr Jovicic does not speak the language and has been forced to live on the streets.

His sister Susanna Jovicic is pleading for him to be allowed to return home.

"Bring him home because Robert is Australian," she said.

"You can't just throw someone who's been here all their life and calls this place his home and just dump them somewhere else.

"I mean he wasn't even born there."

Ms Jovicic says her brother is suffering from a range of physical and mental problems and she is not sure how much longer he can cope on his own.

"You feel like he's lost his mind," she said.

Desperate

Mr Jovicic has told the ABC TV's Lateline program his situation is desperate.

"I've lost everything. I've lost my princess, my wife, my home, my health. Look, my hair is falling out," he said.

"If I don't lay out front of the embassy and get back home, I will die here on medical grounds alone.

"I have been sent to this country, which I have never been before, I had nowhere else to go. The money had run out. I have got no documents."

Unfair punishment

Labor immigration spokesman Tony Burke says the punishment is way out of proportion to the crime.

Mr Burke says Mr Jovicic has spent most of his life in Australia and should be Australia's responsibility.

"We've got a problem now of a punishment that appears to be going on in his life that is way out of whack, completely disproportionate to the crimes that it's reported he's been convicted of," he said.

"Nobody should ever be rendered stateless."

The Immigration Department stands by the decision to deport Mr Jovicic and says he could still apply for Serbian citizenship.

It says Mr Jovicic has a substantial criminal record and it was within the discretion of the Minister to cancel his visa.

THE Federal Government has offered a Melbourne man deported to Serbia temporary housing and medical checks, but is standing by its decision not to allow him back in the country.

Robert Jovicic said he was deported to Serbia, a country he has never set foot in, by the Federal Government in June 2004 despite having lived in Australia for 36 years.

He arrived as a two-year-old in Australia in 1968 from France, where he was born, along with his Serbian-born parents, brother and sister.

But last year, the Government deported him on character grounds after he had been jailed for committing a string of burglaries to support his heroin habit.

For the past two cold winter nights in Belgrade, Mr Jovicic has camped outside the Australian embassy in a desperate attempt to be returned to Melbourne.

A Department of Foreign Affairs spokeswoman said Mr Jovicic had been given three nights' accommodation and the embassy had arranged for a medical examination and medicine.

"The embassy has assisted him as a compassionate gesture while it seeks support for him from local welfare organisations," the spokeswoman told AAP.

"But he has no entitlement to consular assistance from the Australian Government because he is not an Australian citizen or permanent resident."

She said the embassy was also contacting Mr Jovicic's father in Serbia, but to date he was unwilling to assist.

Mr Jovicic's sister Susanna had also been asked by consular officers in Canberra to assist.

But the spokeswoman said Mr Jovicic had refused assistance from the embassy to help resolve his status in Serbia.

"In the interests of his own welfare he needs to resolve his own citizenship status in Serbia and Montenegro so he can obtain medical and other assistance from Serbian authorities," she said.

Susanna Jovicic wants the Government to allow him to return to Australia.

"You can't just throw someone who's been here all their lives and calls this place his home, and just dump them somewhere else," she said on ABC radio.

"I mean, he wasn't even born there."

Ms Jovicic said her brother was suffering from a range of physical and mental problems and she was not sure how much longer he could cope on his own. Director of Edmund Rice Centre, an Australian religious advocacy centre, Phil Glendenning supported her calls.

"First of all, this gentlemen should be able to come home to be with his family who can care for him as he recovers from the physical and mental problems that he has," he said.

"Secondly, the Federal Government needs to stop deporting people out of this country on papers that are questionable.

"We can no longer have a situation where we deport people, we dump them and then we leave them."

Labor immigration spokesman Tony Burke said the punishment was out of proportion to the crime.

"We've got a problem now of a punishment that appears to be going on in his life that is way out of whack, completely disproportionate to the crimes that it's reported he's been convicted of," he told ABC radio.

"Nobody should ever be rendered stateless."

The Immigration Department last night released a statement to the ABC saying Mr Jovicic had a substantial criminal record and former immigration minister Philip Ruddock had used his discretion to cancel his visa under the Migration Act.

As a result, Mr Jovicic is permanently banned from entering Australia. It (the Migration Act) stated Mr Jovicic was not considered a stateless person when he was deported because the department expected he would have the right to stay in Serbia.

I right do not have ningun to think, in a so delicate case (to be the laws of Australia) But I ask myself: if Mr. Jovicic were 36 years old living in Australia, like he is that not yet?? had the Australian citizenship

Re: Australian Immigration Department > Disgusting!

I think deportation is fair - if someone who's not an australian citizin refuses to abide by australian laws then its fair they should be sent back to where they came from, but they should have sent him back to france? Doesnt everyone have a citizinship somewhere? So if he was born in france he should have a french citizinship shouldnt he?

Re: Australian Immigration Department > Disgusting!

Phillip Ruddock is showing the true aussie spirit by doing this isn't he? NOT!!!!!!
yeah, this guy has broken the law so why not give him the punishment to fit the crime? deportation is a bit rough, especially in this case where he has been shipped back to a country that he has never set foot in. he wasn't even born there. maybe mr ruddock just wanted to try and sweep the problem under the carpet cos it was in the too hard basket. just ship him off somewhere, nobody will know. guess he got caught.
reckon this guy should have applied for an australian citizenship a long time ago, that would have made him legal at least.

Re: Australian Immigration Department > Disgusting!

I understand he has committed crimes in the past, but to deport a father and a loving husband is going too far! I feel for this bloke, he was addicted to heroin and stole money to support his habit .... anyone can become addicted to drugs, alcohol, gambling and these addictions can and will destroy your life, you become desperate to satisfy it. In the end his addiction went to far ... blah blah blah!

The government did nothing to help this bloke by deporting him ... he is sick, the Serbian government does not want him, nor does it recognise him.

All I can say is Shame Australia, Shame!

Re: Australian Immigration Department > Disgusting!

So are they going to deport the so called terrorists in Sydney if they are found guilty as well?
I doubt it- might upset too many people...

This is a bit different than terrorists I feel... this person had / has medical, pyschiatric, health problems, and the government just dumped him in a land unkown to him away from his wife and family.
